Terms of Service

AIbudget is a cloud-based production budgeting platform for film, television, and commercial production teams. The Service provides collaborative budget creation, real-time editing, PO log tracking, payroll logging, AI-assisted document extraction, and production reporting tools.

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@aibudget.co if you believe your account has been compromised.

You may not create multiple accounts to circumvent account restrictions or share your account with others.

You agree not to use the Service to:

• Upload content that infringes any third-party intellectual property rights
• Transmit any unlawful, harassing, defamatory, or fraudulent material
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Reverse engineer, decompile, or extract the source code of the Service
• Use automated means (scrapers, bots) to access the Service without prior written consent
• Resell or sublicense access to the Service to third parties
• Use the Service in any way that could damage, disable, or impair the platform or interfere with other users

We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.

The Service includes AI-powered features that extract data from documents you upload (invoices, payroll reports). When you use these features:

• Files are sent to Anthropic’s API for processing. Files are transmitted securely over HTTPS and are not retained by AIbudget after processing is complete. Anthropic’s use of submitted data is governed by Anthropic’s Privacy Policy.
• You are responsible for ensuring you have the right to share any documents you upload for AI processing, including any personal data contained in payroll records.
• AI output is not guaranteed to be accurate. Always review extracted data before importing it into your budget. The Service is a tool to assist your workflow, not a substitute for professional financial judgment.
• The AI production report feature generates analysis of your project’s financial data. This is informational only and does not constitute accounting, legal, or financial advice.

Our IP. AIbudget, its logo, software, and all related content are owned by FS MEDIA and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.

Your Content. You retain ownership of all budget data, project information, and other content you input into the Service (“User Content”). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Service to you.

We do not claim ownership over your production budgets, project data, or financial information.

The Service is currently available free of charge. We reserve the right to introduce paid subscription plans in the future. If we do, we will provide reasonable advance notice to existing users. Continued use of the Service after any pricing changes take effect constitutes acceptance of the new terms.

We reserve the right to limit features, storage, or usage for free-tier accounts at any time.

Our collection and use of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) any errors or defects will be corrected; (c) the Service or its servers are free of viruses or harmful components; or (d) the results obtained from using the Service will be accurate or reliable.

You acknowledge that production budgeting involves inherent business judgment. The Service is a tool, and we make no representations about the financial outcomes of productions managed using AIbudget.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FS MEDIA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless FS MEDIA and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

You may delete your account at any time. We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms.

Upon termination, your right to access the Service ceases immediately. We may retain certain information as required by law or as described in our Privacy Policy. Provisions of these Terms that by their nature should survive termination shall do so.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice in the Service before the change takes effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.

Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and FS MEDIA regarding the Service and supersede all prior agreements.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force.

No Waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.

Assignment. You may not assign these Terms or your account without our prior written consent. We may assign our rights under these Terms freely.
